It is often said that arbitration is not now popular. My experience is that whilst it is not as popular as it was in the 1980s and 1990s, there is still a need for arbitration in the construction industry. The Arbitration Act 1996 was drafted to overcome some of the negative points of arbitration over the preceding 40 years and gives arbitrators the powers they need to manage and control arbitration so that the process can be fast and efficient. This in turn leads to lower costs than would otherwise be the case. There is no doubt that arbitration will continue to have a place in construction disputes having the advantages over adjudication that the successful party can recover their costs and the parties can concentrate time and effort on the details that matter.
